To the full extent permitted by law, BitMoby and its officers, employees, agents and associates exclude all liability for any loss or damage (whether direct, indirect, special or consequential) which may be suffered or incurred from the use of, or reliance upon, the information contained on, distributed by, purchased, procured, downloaded or accessed from this site.

In particular, BitMoby accepts no liability for loss of business, personal distress, inconvenience or any other damage associated with or resulting from accessing, procuring or downloading the information, products or service on this website or through use of BitMoby services.

Any warranty or condition that would otherwise be implied in this agreement is excluded to the full extent permitted by the law. Where statute implies any condition or warranty in relation to your use of this website and that statute prohibits and exclusion or modification of that then, then that term is included in these conditions.

However, the liability of BitMoby is limited, at your option, to one of the following:

(a)   if the breach relates to goods:

(i)  the replacement of the goods or the supply of the relevant goods;

(ii)  the repair of the goods;

(iii)  the payment of the cost of replacing the goods or of acquiring equivalent goods; or

(iv)  the payment of the cost of having the goods repaired;

(b)   if the breach relates to services:

(i)  the supplying of the services again; or

(ii)  the payment of the cost of having those services supplied again.

Reliability and Performance are not Guaranteed

BitMoby obtains products and information from third parties and cannot guarantee the reliability or performance of this information. In particular it advises that:

(a)    mobile handsets must support short message services (SMS) in order to accept top-up notification information;

(b)    information is delivered to handsets via third party mobile network operators and therefore delivery can not be guaranteed.

(c)     some products and services may contain expiry dates. You acknowledge that by purchasing products and/or services from BitMoby, you accept the terms of these expiry dates.

Acknowledgement of Copyright

This website and its contents are subject to copyright under the laws of Australia and by international treaty. By accessing this website you agree to comply with these laws. This means that you may not reproduce, copy, transmit, adapt or otherwise infringe the copyright in the whole or part of this website for any purpose otherwise than as allowed by this agreement or under the law.

Choice of Law

By accessing BitMoby you accept that any disputes about this website or the information contained on this website are to be determined by the law and courts of the Australian Capital Territory. All information transfers from this website shall be deemed to have taken place within the Australian Capital Territory.

Marketing Policy

BitMoby may collect personal information as outlined below. This information may be used to market or promote new services and products that we believe may interest you. This marketing will be by way of an email or SMS for each product or service.

BitMoby will never give your personal information (including your email address) to third parties.

IP Addresses

BitMoby servers automatically record IP addresses along with which pages were visited within the BitMoby site and which information is previewed. This information is important to maintain and improve the BitMoby website and locate problem areas within our servers. No personal details are recorded with this information.

Information about total site usage it collected and aggregated and may be revealed to advertisers. However at no time will personal or individual information be made available to partners or advertisers. BitMoby servers may log the last site you visited before the BitMoby website. This is done to best determine how to promote the BitMoby website. The information is recorded anonymously and will not be disclosed without your express permission.

BitMoby reserves the right to record IP addresses and other user-identifying information in order to prevent improper or illegal conduct or conduct that otherwise violates this agreement.

Cookies

A cookie is a packet of information sent from BitMoby servers to your computer that may be returned to the BitMoby website on a subsequent visit.

BitMoby uses cookies to remind us of who you are, to allow us to tailor our site to suit your needs and to ensure that you receive the proper information from our databases while you visit our site.

BitMoby may sometimes pass on the information gained from the use of cookies to partners or advertisers. However, we will always ensure that such information is anonymous.

Staff and Contractors

BitMoby requires all staff to sign non-disclosure agreements and to abide by the principles of this privacy policy.  If contractors or other third parties are engaged to perform tasks on our behalf, BitMoby will ensure where possible that all information is provided anonymously. Where this is not feasible, BitMoby will require that contractors or other third parties sign non-disclosure documents or otherwise deal with any information gained in the course of their duties in a manner that is consistent with the principles of this privacy policy.

Security

BitMoby has put in place security measures designed to ensure the security and integrity of all information under our control. BitMoby will use it's best endeavours to ensure that these measures are kept up to date.

Failed Transactions

We do not automatically provide refunds on failed transactions. We reserve the right to not refund your Bitcoin if your mobile number is black listed, blocked, has reached a top-up limit or has otherwise been rejected by your mobile network operator.

Expired Transactions

If you send us Bitcoin after the transaction expiry, we will not process your transaction and you may loose your Bitcoin. Unless you contact us, we will not attempt to re-send your top-up nor will we refund your Bitcoin.

Refund Policy

Unless contacted by you, we will not automatically refund your Bitcoin for a failed transaction. We also reserve the right to provide credit, or top-up an alternative mobile number instead of refunding your Bitcoin.
